1 - GENERALITIES

The buyer accepts without reservation all the General Terms and Conditions of Sale, which he acknowledges having taken note of before confirming his purchase. We shall not recognise any different General Terms and Conditions of Sale of the other contracting party, unless we have consented to their applicability in writing.

2 - ORDER CLAUSE

Any order placed to our company is firm and definitive, unless we have consented to it in writing.

The valid price list on the date of the order shall apply to orders. Prices are net, ex-works Nouaillé –Maupertuis (86) France.

3  - CLAUSE OF RISK TRANSFER

The goods travel at the buyer’s risk, whatever the chosen shipment term, even in carriage paid. In the event of a damaged parcel or order, the buyer shall notify it upon reception on the delivery document.

4 - SHIPMENT CLAUSE

Delivery time is for information only. Unless we sign a special term regarding our responsability, the buyer cannot refuse the goods, cancel the order or claim damages for delayed delivery.

 

5 - CLAIMS

To be entitled , a claim must be proceeded within 8 day after receipt of the goods (maximum 4 months after shipment date). The goods that we recognise as defective by our service, will be exchanged after our agreement ( excluding any other compensation).

No goods can be returned without our agreement and must have a dispatch note and be properly packed. Shipment and costs have to be agreed by our service.

6 - FINANCIAL CLAUSES

Export : Orders are shipped on pro-forma invoice with payment before delivery by swift transfer. For new customers and special order, a 30 % deposit is required at the order confirmation.

7 - CLAUSE OF OWNERSHIP

The ownership of sold goods will belong to the buyer only after  complete payment of the price.

8  - TERRITORIAL CLAUSE OF JURISDICTION

The General Terms and Conditions of Sale are subject to the French law (Tribunal de Commerce de Poitiers)
